Examples include:

  3. Structural damage

  4. Significant pipe displacement

  5. Inaccessible drainage systems

  6. Obstructions requiring excavation

6.5 Additional repairs will not proceed without customer authorisation.

6.6 Nothing in this section removes the customer’s rights where services have not been performed with reasonable care and skill.

7. CCTV DRAINAGE SURVEYS

7.2 Survey findings may be limited by:

  1. Restricted access

  2. Standing water

  3. Heavy deposits

  4. Obstructions

  5. Poor visibility

  6. Pipe configuration

7.3 CCTV inspections do not guarantee the identification of every hidden or inaccessible defect.

7.4 Any report supplied will reflect the findings and limitations of the inspection.

8. CUSTOMER RESPONSIBILITIES

The customer agrees to:

8.1 Provide safe and reasonable access to the working area.

8.2 Inform us of known drainage defects, hazards or access restrictions.

8.3 Provide access to water and electricity where agreed and reasonably necessary.

8.4 Inform us of known underground services, private drainage arrangements or relevant property restrictions.

8.5 Obtain any permissions for which the customer has expressly agreed to be responsible.

8.6 Ensure children, pets and unauthorised persons remain clear of working areas.

Axis Drains Ltd remains responsible for carrying out its own appropriate safety assessments and taking reasonable precautions.

9. EXISTING DAMAGE AND DEFECTIVE DRAINAGE

9.1 Drainage systems may contain pre-existing defects, including cracks, corrosion, displaced joints, root damage and structural deterioration.

9.2 High-pressure jetting and mechanical clearance may expose existing weaknesses.

9.3 Where significant defects are identified, we may recommend alternative methods or further investigation.

9.4 We will take reasonable care to avoid damage when carrying out our services.

9.5 Axis Drains Ltd is not responsible for damage solely attributable to pre-existing defects where the Company has exercised reasonable care and skill.

10.5 Any required permits, permissions or approvals will be identified and responsibilities agreed before work begins.

11. CANCELLATIONS AND CONSUMER RIGHTS

11.1 Customers may request cancellation by contacting Axis Drains Ltd.

11.2 Where a consumer contract is agreed by telephone, online or away from our business premises, statutory cancellation rights may apply.

11.3 Where applicable, consumers will receive the required cancellation information before the contract is agreed.

11.4 Where a consumer expressly requests that services begin during a statutory cancellation period, we will obtain the necessary express request and explain the consequences.

11.5 If a consumer validly cancels after requesting that work begin during the cancellation period, reasonable proportionate charges may apply where permitted by law.

11.6 Certain urgent repairs or maintenance specifically requested by the consumer may fall within the statutory emergency-repair cancellation exception.

12. APPOINTMENTS AND DELAYS

12.1 We will make reasonable efforts to attend at the agreed time.

12.2 Emergency attendance times are estimates unless expressly guaranteed.

12.3 Delays may occur because of traffic, severe weather, previous emergency work, access restrictions or other circumstances outside our reasonable control.

12.4 Customers will be informed of significant delays where reasonably practicable.

12.5 Where we cannot provide the service within the agreed timeframe, the customer retains any applicable legal rights.

13. GUARANTEES AND WARRANTIES

13.1 Any specific workmanship guarantee will be confirmed in writing.

13.2 A successful drain clearance does not guarantee that a drainage system will remain free from future blockages.

13.3 Subsequent blockages may arise from new obstructions, misuse or existing structural defects.

13.4 Any contractual guarantee is additional to the customer’s statutory rights.

13.5 Nothing within these terms excludes responsibility for defective workmanship.

14. HEALTH AND SAFETY

14.1 Axis Drains Ltd reserves the right to suspend or decline work where conditions present an unacceptable safety risk.

14.2 This may include unsafe excavations, hazardous substances, suspected asbestos, dangerous structures or unsafe access.

15.4 Nothing in these terms limits a consumer’s statutory rights or remedies.
